Dangerous?<p><i><b><span style="font-size: medium;">Update:</span></b> On Nov. 28, 2023, <b>despite the absence of any traffic study.</b> the Board of Sarasota County Commissioners voted 4-0 to approve the Sarasota Baptist windfall proposal for 87 unaffordable homes on Hand Road. </i></p><p><i>Six people from the community offered several reasons that a rational judge would consider to be compelling, but not this Board. The road can’t handle any more traffic."</span></i></div><div><br /></div><div>Why CARELESS?</div><div><ul><li>The plan produced by Bo Medred of <a href="https://business.ms-bia.org/list/member/genesis-planning-and-development-1910" target="_blank">Genesis Planning & Development Inc</a>. seems fundamentally flawed -- nowhere does it address these unique conditions. </li></ul><ul><li>Sarasota County has a rule that a traffic study is only triggered when a certain number of new homes are to be built. When a co-worker of Pastor Lewis was contacted, she assured us that Lewis had received emails of concern from Lake Sarasota (sent via the <a href="https://sarasotabaptist.com/i-m-new" target="_blank">church site</a>), but indicated that he would not be available to take calls or to speak with residents. Emails sent to him via his site have gone unanswered.</li><li><span>When local residents brought intimate knowledge of traffic conditions that raise concerns, the Planning Commission voted for the plan without any stipulations or recommendations to scrutinize our safety considerations.</span></li></ul><div>DANGEROUS:</div><div><ul><li>Hand Road is a major access driveway for our kids and parents every day (8am and 3pm). It does not address the volume of cars, the walkways children use, or the straightaway on Lago leading to the sharp curve to Hand Road. And, it doesn't use actual traffic counts, only misleading estimates. For example, it states that the traffic levels on Proctor Road have not increased in the past three years - anyone hearing this who lives or drives along Proctor would <b>laugh out loud.</b></li></ul><p></p><div></div><p>On Tuesday Nov. 28 the County Commission will consider and possibly approve this project. The community of Lake Sarasota has roughly 1,600 homes. Yet when a poorly conceived proposal to wedge 80+ homes onto a narrow road, at a tight blind curve, where two schools tie up traffic each day both in the morning and afternoon, very few residents were notified about the Neighborhood Workshop. I live on the street that leads to this proposed disaster - if built, I would see it from my home - yet I was not informed of two workshops held by Bo Medred months ago. A handful of residents actually attended.</div><div class="gmail_default"><br /></div><div class="gmail_default">So the first point is, the County planning code should drop the 750-foot rule and replace it with a competent planner's sense of what homes, roads, and areas will be directly impacted by a proposed project.</div><div class="gmail_default"><br /></div><div class="gmail_default">2. The proponents of filling this open space with homes ignore all of these issues. </b>Instead of coming to our community to hear our concerns, Sarasota Baptist and David Weekley homes have ignored us.<b> Needless to say, they have not offered to mitigate dangers -- e.g. install signage, traffic calming, etc. Nothing whatsoever.</b></div><div class="gmail_default"><b><br /></b></div><div class="gmail_default"><b>Our concerns include </b></div><div class="gmail_default"><ul><li style="margin-left: 15px;"><b>a. The safety of our children,</b> who walk or ride with their parents on Hand Road to Lakeview School each day, and the students of Oak Park, most of whom are bussed to school.</li><li style="margin-left: 15px;"><b>b</b>. Instead of exploring <b>alternative routes</b>, such as proposing to make Falcon Place or another road provide an exit to Proctor Road, they simply opt to have two entrances / exits on Hand Road, <b>one quite near the blind curve</b>.</li><li style="margin-left: 15px;"><b>c. No traffic study has been done. </b>The county sees 80 homes as too few to require a study - but<b> local knowledge</b> of Hand Road's challenges - and the fact that it is the sole exit from Lake Sarasota to the South, making it a key evacuation route - would make anyone with an understanding of traffic realize that a traffic study is needed in <b>due diligence to determine danger</b>. Accumulative Traffic/Congestion</b></p><p>We assert that the traffic study was inadequate and incomplete because it did not include traffic measurements at peak times such as when school starts and lets out, commute hours, church hours and levels on voting days. Because of congestion on Bee Ridge around Cattleman many people in Lake Sarasota are opting for using Hand to Proctor. However passage on Hand when school lets out is impossible.</p><p><br /></p><p><b>2. Restrictions, Stipulations and Safeguards</b></p><p>We request a revised <b>Binding Concept Plan</b> along with multiple restrictions stipulations and safeguards be implemented</p><p>Significant Flooding in larger storm events. A new and better drainage system should be put in. Flooding prevents access to the sidewalks for school children. An improved sidewalk and pavement section is needed to support the safe movement of children and parents.</p><p>The roadway including Lago Road is in significant disrepair including dangerous potholes and it needs to be upgraded.</p><p><br /></p><p><b>3. Increased density</b></p><p>Allowing for increased density is not compatible with that of the surrounding community and existing surrounding developments. With the proposed level of increased density the quality of life for our entire community will decline</p><p><br /></p><p><b>4. Reduced Open Space</b></p><p>It is a given that we humans need open space for quality of life. Because this proposed development significantly reduces open space, some <b>offsetting mitigation</b> should be included in the Plan prior to approval.</p><p><br /></p><p><b>5. Evacuation Emergency</b></p><p>In the event of an emergency evacuation, two lanes on Hand would be the only route out and would be disastrously inadequate. It has been suggested that connection to alternate routes should be strongly considered. One would be to build a connecting road and widen Falcon Place. A second could be to connect Jarvis to an internal road within the new subdivision, or all the way to Proctor.</p><p><br /></p><p><b>6. Inadequate Notification of Planning Commission and Board of Commissioners hearings.</b></p><p>We assert, despite minimal requirements to do so, that the entire Lake Sarasota Community should have been noticed because most -- if not all -- community residents will be impacted. Our community has been in existence since the 70’s. Multiple generations have grown up here, attended Lakeview Elementary, and are now living here so their children can attend Lakeview Elementary and enjoy our small slice of community heaven. </li><li>The remaining properties surrounding the area include a OUE -1 and OUE-2 (very limited density, and lots of open space), as well as RE-1, RE-2, RSF-1 and RSF-2. </li><li>The Hand Road property currently is zoned OUE, with a special exception of which had to be approved by the community, the board and the commission back in 1985.</li><li>This Special Exception was required, since the property use is not consistent with Zoning and FLU. This special exception was deemed to be an improvement and additional resource to the area, as the use of the request (church) was complementary to the existing schools and low-density development in the area. The church site is also a polling location. And <b>the Binding Concept plan restricted significant density to the parcels now being extracted from the Special Exception.</b></li><li>The Special Exception modification and the concurrent Re-zone will significantly reduce the amount of OPEN SPACE previously agreed upon as to for the Special Exception. How can the County allow for such a significant reduction of OPEN Space without mitigation measures, such as additional restrictions, stipulations, or safeguard measures?? </li><li>The Special Exception is now being modified to further increase the density of the land, and add undue burden to the surrounding communities, of which were permitted and designed under their CURRENT ZONING AND FLU. </li></ul><p></p><p><b>Summary on Special Exception inconsistencies/Issues:</b></p><p>Special Exception 1008 – 1985 – County records for Special Exception Binding plan – cant find? – however – see swfwmd plans – the additional parcels outside 26 ac not shown . . . until future plans in 2001</p><p>EXPANSION OF CHURCH FACILITY -- Special Exception petition 1532 was DENIED – resolution No 2003-128—see existing special exception language ---</p><p><b>How can the county move forward without addressing the existing special exception?? </b>It has a binding concept plan, and something just as detailed should replace it!!!</p><p>It appears they are not currently adhering to the existing stipulation #6!!!!</p><p>Why is the 28 ac not subject to a binding concept plan ?</p><p>Why are they asking for RSF-4? <b>What is going to keep them from increasing the unit count from 80 to 28.3*4.99 = 141 units?</b></p><div class="blogger-post-footer"><!-- AddThis Feed Button BEGIN -->

As residents know, Hand Road is basically blocked by school traffic every morning and afternoon as parents and buses usher kids to and from school.</p><p>The plan raises additional safety issues as well. The 90-degree curve from Lago Street onto Hand Road is basically blind, and it's at this curve that school kids cross the road each weekday to and from their schools - Lakeview Elementary and Oak Park. </p><p>Before the 90-degree curve, Lago Street is a long straightaway where drivers enjoy building up speed. The layout calls for two entrances/exits onto Hand Rd. from the new cluster, to be built by <a href="https://www.davidweekleyhomes.com/">David Weekly Homes</a>. </div><div class="separator" style="clear: both; text-align: left;"><br /></div><div class="separator" style="clear: both; text-align: left;"><b>The <a href="https://www.scgov.net/home/showpublisheddocument/61591/638234742467270000" target="_blank">development proposal, which can be found in full here</a>, raises questions.</b></div><div class="separator" style="clear: both; text-align: left;"><br /></div><div class="separator" style="clear: both; text-align: left;">For example, what will be the impacts on traffic on Hand Rd., a narrow two-lane road which has two schools - Lakeview Elementary and Oak Park - that attract large numbers of cars and buses on weekday mornings and afternoons?</div><div class="separator" style="clear: both; text-align: left;"><br /></div><div class="separator" style="clear: both; text-align: left;">In addition, Lake Sarasota is currently facing another developer's initiative - a <a href="http://lakesarasota.blogspot.com/2023/07/west-bridge-meeting-summary-and-next.html" target="_blank">208-unit condo proposal called West Bridge</a> that would squeeze into the wooded land between Molokai and I-75. This project. would add some 400 cars to Lake Sarasota's internal streets, primarily Jarvis, which leads to Hand Road. </div><div class="separator" style="clear: both; text-align: left;"><br /></div><div class="separator" style="clear: both; text-align: left;">The Sarasota County <b>Planning Commission will review the Hand Road proposal on Thursday, September 21, at the Administration Building 1660 Ringling Blvd. (These meetings begin at 5 pm.) </b>The project is identified as "Sarasota Baptist Residential Development." Anyone who wishes may sign a card to speak for 5 minutes to the Commission. We are opposed to this type of development, not to the current zoning for single-family dwellings. No number of amenities or concessions offered by the developer in the neighborhood workshop were persuasive to the twenty-thirty people who came or attended via video last night. </span></p><p dir="ltr" style="line-height: 1.295; margin-bottom: 8pt; margin-top: 0pt; text-indent: 36pt;"><span face="Calibri, sans-serif" style="background-color: transparent; color: black; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline;">The community wanted me to share this message, too: please, know that this and other developments in the area will affect every one of us, from Molokai to Berkshire, From Jarvis to Bee Ridge. This is not just Molokai’s or Jarvis’s problem. Jarvis, Molokai, and Kahana and surrounding streets will be absolutely changed from sleepy dead ends to boulevards. And when asked what happened and why, he gave us the verbal equivalent of “none of your business.” In addition, he has been illegally attempting to clear other land along the creek where he wants to develop without permitting. Thanks to diligent neighbors, he has been fined for this activity. It's about a new proposed set of high-rise condos on the sliver of wooded land between Lake Sarasota and I-75.</p><p>The developer will be going to the County with a new plan for 208 (or possibly more) dwelling units on 24.5 acres, to be called West Bridge at Lake Sarasota.</p><p>Access to the land will solely be possible through roads within Lake Sarasota. The Bee Ridge intersection at Mauna Loa will be challenged by intensification. This road is entirely residential - it's not a thoroughfare, artery, or connector road. School Buses drop off many children at various times; they walk and play along Mauna Loa's sidewalks. (Within the same North Mauna Loa cul de sac, Ridge Lake and Horton's Townhouses have added hundreds of new residences in recent years). </div><div class="gmail_default"><br /></div><div class="gmail_default">Another recommendation for you to consider: In order to offset the new intensity, the county can install traffic calming both near the Mauna Loa entrance and along its length.</div><div class="gmail_default"><br /></div><div class="gmail_default">2. The 2014 Covenant worked out by Lake Sarasota and TerraCap goes back to concerns expressed by residents of our community who live across Bee Ridge Road from the BRPOC. The overall intent of the petitions is to re-redesignate 8.87 acres +/- of the 26.05 acres +/- owned by Terracap BR Partners LP from Neighborhood Commercial to Major Employment Center (MEC) on the Future Land Use Plan. This will allow the Owners to process a Rezone/Special Exception on 17.18 acres +/- currently zoned PCD (Planned Commerce Development) without a Binding Development Concept Plan and CN (Commercial Neighborhood) to PCD with a Binding Development Concept Plan.<br />

But here's what I've gathered from reading it: There are a bunch of people who own undeveloped wooded lots in Lake Sarasota abutting Route 75. These landowners (of the wooded lots) want to sell their properties to developers. A "Development Review Committee" has already met (on July 19, 2018) and seemingly approved the development of the wooded lots. BUT...residents of Lake Sarasota had created the "1988 Declaration of Restrictions for Lake Sarasota, the 1995 Amendment to the Declaration of Restrictions for Lake Sarasota, and the 1996 Declaration of Restrictions for Lake Sarasota", which made it illegal for those wooded lots along 75 to be developed. The owners of the wooded lots have seemingly contracted lawyers to try and nullify the Declarations of Restrictions so that the land can be developed. It seems that anyone who received the letter has legal recourse because the decision of whether or not to develop will impact our property values. We will in no way be compensated for how this affects our property values, but they have given us a thirty-day window to complain or hear our grievances. The land lies behind, as well as both west and east of Racetrac.<br />

TerraCap recently asked <a href="http://lakesarasota.blogspot.com/2018/09/fall-meeting-of-lscg-with-terracap.html" target="_blank">whether the community would accept an automated car wash</a> east of Ractrac on Bee Ridge, and multi-family housing behind the service station - both uses are restricted by the Covenant. <a href="https://drive.google.com/file/d/0BwQWD3s552SeNVBuUFVvMkhUNE84by1UZDZmWGhBRVFhVW9B/view?usp=sharing" target="_blank">The Covenant document is here</a>.<br />

A representative of TerraCap, the Canadian owner of the land north of Bee Ridge at Mauna Loa, will attend. TerraCap has been approached by a number of businesses seeking sites on its property, and one or more of them could present a potential conflict with the <a href="https://drive.google.com/file/d/0B3wQrRxjFE-zSkNvQ2FNMWdzZDRSWlFiNFIxVW8tZkhkNmww/view?usp=sharing" target="_blank">Declaration of Covenant signed by TerraCap in 2014</a>. That document lists a variety of kinds of businesses that might create a nuisance for residents of Lake Sarasota, especially those who live near Bee Ridge Road. The group might be asked to discuss and offer input on these potential neighbors. There will also be an update on the existing developments now on the site. HealthSouth, for example, could be expanding, and Ridgelake, a new apartment complex with something like 324 homes is taking up a large swath of the north side of the property.<br />

Anyone who wants to participate is welcome to.<br /><br />In addition, if you have items to sell but don’t want to hold your own yard sale, you can donate them to be sold to benefit the neighborhood group. Feel free to drop them off anytime at 4032 Westminster Drive. Thank you!<br /><br /><br />FPL update from Keith Russo<br /><br />FPL had a public forum six weeks ago. Power lines need to be connected. Along 75 between Proctor and <a href="https://maps.google.com/?q=Fruitville.+40-80&entry=gmail&source=g">Fruitville. 40-80</a> foot tall power lines.<br /><br />One option would be straight down bee ridge, another goes along Clark, a third along Fruitville Rd. All end near the Hi Hat Ranch, a 10,000-acre area that is going to be developed in the near future.</span><br />

It looks the least populated, and we sure don’t want it going down Bee Ridge.<br /><br /><br />Fresh Start update from Tom Matrullo:<br /><br />Proposals from residents were due today for uses on <a href="http://freshstartsarasota.blogspot.com/2018/02/fresh-start-what-and-why_25.html" target="_blank">public lands next to the Celery Fields</a>. Some interesting ideas have come in; some would actually make money. An advisory board is meeting to look at all the proposals. A public workshop will be held on April 10 at the Fruitville Library for a roundtable vote on the proposals preferred by the community.<br /><br />Hoping to get some press so that while this is going on, the county sees that we’re doing something and have community support.<br /><br /><br />Tom brought also to our attention the issue of the <a href="https://www.facebook.com/keepdemocracysafe/" target="_blank">Sarasota Alliance for Fair Elections</a>. It would change how county commissioners are elected, and Tom hopes it would diversify the county government and also make it more affordable to run. He was told it will cost $50,000 to run for county commission because they have to reach the whole county with advertising.<br /><br /><br />We got a rundown from Tammy of a year’s worth of crime in Lake Sarasota. The biggest problem is people stealing things out of unlocked cars. Remember to lock your vehicles!<br /><br /><br />At this week’s neighborhood meeting, we talked about a common complaint in Lake Sarasota: speeding vehicles. The sheriff’s department said they make decisions about patrolling neighborhoods based on the volume of complaints they get.
